These Terms of Sale (Terms) define the conditions under which the CraftMySurvey service (the Platform) is offered to users (the Client). CraftMySurvey is an online survey creation and data analysis platform operated by Antoine Collard, sole proprietor registered in France (SIRET: 95244892600016).

Using the Platform or subscribing to any offer implies acceptance of these Terms without reservation. They describe the rights and obligations of the Client and the Platform editor in the context of using CraftMySurvey services.

By creating an account or subscribing to a plan, the Client declares having read and fully accepted these Terms. During registration or subscription, the Client must validate a checkbox confirming acceptance. Without acceptance, the Client cannot use CraftMySurvey services.

CraftMySurvey may modify these Terms to adapt to service evolution or legal requirements. The Client will be informed of updates by appropriate means (site notice, email, etc.). Continued use after modification constitutes acceptance of the updated Terms.

The Platform is accessible at craftmysurvey.com and requires an Internet connection and a recent web browser. The service is normally available 24/7, but access may be interrupted for maintenance, updates or force majeure. The Client will be notified in advance when possible.

Access to certain services may require an account. The Client is responsible for keeping login details confidential. Any action performed through the Client's account is presumed to be by the Client. In case of unauthorized use, the Client must immediately contact CraftMySurvey to suspend or secure the account.

To use the Platform, the Client must create an account with accurate, complete and up-to-date information (name, email, etc.). The Client agrees not to create a false identity or impersonate a third party and to update personal information without delay.

The user account is strictly personal. The Client is responsible for password security and account access. Any use of the account by a third party is prohibited. In case of breach (inaccurate information, shared account, etc.), CraftMySurvey reserves the right to suspend or delete the account after notifying the Client when possible.

CraftMySurvey offers a free plan and paid subscriptions with additional features. Current subscription prices are shown on the site (section Pricing) in euros. Unless stated otherwise, prices include all taxes (VAT not applicable, article 293 B of the French Tax Code for Clients located in France).

Payment for paid subscriptions is made in advance according to the chosen period (monthly, yearly, etc.) by credit card via a secure payment provider. In case of payment failure or delay, CraftMySurvey may suspend access to the paid features. Invoices are issued electronically and available on request or in the Client's personal area.

CraftMySurvey reserves the right to change prices. Any change will be communicated to the Client before it takes effect. New prices apply only to new subscriptions or renewals. If the Client does not accept the new price, they may cancel before the next renewal.

According to Article L221-18 of the French Consumer Code, a consumer Client has fourteen (14) days from subscription to exercise the right of withdrawal without justification or penalty. However, under Article L221-28, this right cannot be exercised for services fully performed before the end of the period or for digital content accessible immediately after the transaction with the consumer's consent.

By subscribing to a paid plan on CraftMySurvey, the Client agrees that service execution begins immediately, expressly waiving the right of withdrawal to access features without delay. Nevertheless, CraftMySurvey offers a 14-day "satisfied or refunded" guarantee: if the Client is not satisfied during the first 14 days, they may contact CraftMySurvey to cancel and receive a full refund.

All content, software, interfaces, graphics, logos, trademarks and generally all elements forming the CraftMySurvey Platform are protected by intellectual property law. Unless stated otherwise, these elements are the exclusive property of Antoine Collard. Subscribing to a plan or creating an account does not transfer any intellectual property rights to the Client, who only has a personal, non-exclusive, non-transferable right to use the Platform during the subscription or service use.

The Client retains ownership of data entered and content created via the Platform (e.g. survey questions or collected results). The Client guarantees they have the necessary rights and do not infringe third-party rights by using such content on CraftMySurvey. The Client grants CraftMySurvey a non-exclusive license to host, store, process and display this content solely for operating the service. CraftMySurvey will not use Client content for other purposes without explicit consent.

By using the Platform, the Client provides personal data (e.g. during registration: name, email, payment info). CraftMySurvey collects and processes this data in accordance with applicable regulations, notably the GDPR and French "Informatique et Libertés" law.

This personal data is used exclusively to operate the service, manage the Client account, billing, platform improvement and, if applicable, sending service-related information. It may be shared with technical providers or partners (such as the payment provider) only as necessary for service execution and under the same confidentiality and security requirements.

CraftMySurvey retains personal data only for the time necessary to achieve these purposes, in accordance with its Privacy Policy (available on the site). The Client has rights of access, rectification, objection, restriction, deletion and portability regarding their data. These rights can be exercised by contacting CraftMySurvey via email or through account settings when available.

The Client, as data controller for surveys, must comply with regulations concerning respondents (information, consent, etc.). CraftMySurvey acts as processor for respondent data and processes it solely on behalf of the Client according to their instructions within the service's functionalities.

CraftMySurvey uses reasonable means to ensure platform reliability and availability but is not liable for interruptions, outages or malfunctions beyond its reasonable control. This includes maintenance, Internet issues, hosting failures, malicious intrusion or other force majeure events.

CraftMySurvey shall not be liable for indirect damages suffered by the Client due to the use or inability to use the Platform, such as loss of profits, opportunity, data or commercial harm. If CraftMySurvey is held liable despite the above, liability will in any case be limited to the amount actually paid by the Client for the current subscription.

The Client is solely responsible for their use of the service, including content created and data collected from survey participants. The Client indemnifies CraftMySurvey against any claims resulting from unlawful data or content stored or disseminated via the Platform, including third-party rights violations or regulatory breaches.

Although CraftMySurvey strives to provide quality service, no advice or information obtained via the Platform or support creates any warranty not expressly stated in these Terms. The Client acknowledges using the service at their own risk.

The Client may close their account or cancel a paid subscription at any time via the personal area or by contacting support. Cancellation of a paid subscription takes effect at the end of the current paid period unless otherwise requested by the Client and agreed by CraftMySurvey. No prorated refund is provided in case of termination during the period, except for exercise of the withdrawal right or the satisfaction guarantee of article 6.

In case the Client breaches essential obligations under these Terms, CraftMySurvey may immediately suspend access or terminate the subscription without prejudice to any damages it may claim. Termination occurs without notice and without refund of sums already paid.

Upon account deletion or contract termination, Client data may be removed from CraftMySurvey servers except for data required by law to be retained (e.g. billing data). The Client is advised to export data before closing the account. CraftMySurvey is not liable for data loss following termination when the Client had the opportunity to retrieve it.

These Terms are governed by French law. In case of dispute over interpretation or execution, the parties will seek an amicable solution. Failing agreement and subject to mandatory consumer law, disputes fall under the jurisdiction of the courts where the Platform editor is based (French courts). This clause is subject to the Client's right to bring proceedings in their place of residence as per applicable regulations.

If any clause is declared null or unenforceable by a competent court, it shall be deemed unwritten without affecting the validity of the remaining provisions.
