Terms of Use
1. Purpose and Acceptance of Terms
These terms of use (Terms) define the conditions for using the CraftMySurvey service (the Service) and the rights and obligations of the parties. Any connection to the site and use of the Service implies unconditional acceptance of these Terms by the User.
The Service is published by Antoine Collard, sole proprietor registered in France under SIRET 952 448 926 00016 (the Publisher). For any question or claim regarding the Service or these Terms, you may contact the Publisher at [email protected].
2. Access to the Service and Registration
The CraftMySurvey service is accessible online at craftmysurvey.com. The User must have an Internet connection and a compatible device. Connection costs remain the User's responsibility.
Registration is required to access all features. The User must provide accurate and complete information when creating an account and agrees to update it if needed. Account access is protected by a password that the User must keep confidential. Any action performed via the User's account is presumed to be carried out by the User.
The Service may offer a free 14-day trial. After this period, some features may only be accessible with a valid paid subscription (see "Subscription and Payment" below). The Publisher reserves the right to refuse registration or access to the Service to anyone not complying with these Terms.
3. Use of the Service
The User agrees to use the Service in accordance with its purpose and applicable laws. It is prohibited to use CraftMySurvey for illegal, harmful, defamatory or otherwise damaging activities.
The User is responsible for the content of surveys created and distributed via the Service. They must ensure that questions and collected data respect third-party rights and regulations (including personal data protection and intellectual property).
When using the Service, the User agrees to:
- Not access or attempt to access other users' accounts or non-public parts of the platform;
- Not bypass or violate security measures on the Site;
- Not use the Service to distribute spam, viruses, malware or destructive code;
- Not impersonate others or provide false personal information;
- Not infringe third-party rights, including intellectual property and privacy.
If these rules or these Terms are violated, the Publisher may suspend or delete the User's account, temporarily or permanently, without notice or compensation.
4. Subscription and Payment
CraftMySurvey offers free and paid services. After the free trial, the User must subscribe to a paid plan to access all features. Subscription rates and details are presented on the Site.
Payment is handled via our secure payment partner (e.g. Stripe). The User guarantees they are authorized to use the chosen payment method and that sufficient funds are available.
Subscriptions renew automatically according to the chosen period (e.g. monthly for a monthly plan) unless canceled before the current term ends. No refund is provided for early termination unless required by law.
5. Intellectual Property
All elements of the Service (texts, logos, graphics, images, software, interface and features) are protected by copyright, trademark law or other intellectual property rights and are the exclusive property of the Publisher unless stated otherwise.
The Publisher grants the User a personal, non-exclusive, non-transferable right to use the Service solely for the purpose of these Terms. Any unauthorized reproduction, modification, distribution or exploitation is strictly prohibited.
Content imported by the User into surveys remains their property or that of their rightful owners. The User guarantees they have the necessary rights and authorizes the Publisher to use this content only for operating the Service.
6. Personal Data
When using the Service, the Publisher may collect and process personal data (e.g. during account creation or survey participation) in accordance with the GDPR and French law No. 78-17 of 6 January 1978 as amended.
The User has rights of access, rectification, objection, deletion and portability over their data, exercisable under the conditions provided by law by contacting the Publisher at the above address. For details on data management, see the Privacy Policy.
7. Limitation of Liability
The Service is provided as is and subject to availability. The Publisher does not guarantee that the Service will be error-free, uninterrupted or perfectly secure. Reasonable efforts are made to ensure proper functioning, but temporary interruptions may occur (maintenance, updates, technical issues beyond control, etc.).
The Publisher cannot be held liable for indirect, unforeseeable or special damages resulting from the use or inability to use the Service (such as loss of profit, opportunity, data, business harm, etc.). Total liability of the Publisher, regardless of cause, is limited to the amount paid by the User for subscription in the twelve (12) months preceding the event causing the damage.
The User is solely responsible for their use of the Service and consequences thereof. They must take necessary precautions to back up information and prevent potential damages.
8. Termination
The User may unsubscribe at any time by deleting their account via the interface or by requesting it from the Publisher. Termination of an ongoing subscription takes effect at the end of the paid period, subject to applicable mandatory law.
The Publisher may suspend or close a User's account in case of breach of these Terms, abusive or fraudulent use, legal decision or obligation. The User will be informed by any available means (email or Site notification) and no compensation will be granted.
9. Changes to the Service and Terms
The Publisher reserves the right to evolve the Service (add/remove features, technical modifications, etc.) to improve user experience or comply with legal/technical obligations. Any substantial change to a subscribed service will be notified to the User when possible.
The Terms may also be updated. In case of changes, the User will be informed (e.g. notice on the Site or email). Continued use after new Terms take effect constitutes acceptance. Users are advised to review the latest version regularly.
10. Governing Law and Jurisdiction
These Terms are governed by French law, both substantive and procedural, notwithstanding mandatory protective provisions of the User's country of residence.
In case of dispute regarding interpretation or execution and absent amicable resolution, jurisdiction lies with French courts. The reference language for interpreting these Terms is French. Non-French-speaking users expressly waive reliance on a translation in support of a claim or action.
